They just don't get that the power of the purse is the best tool of leverage against Barack Obama! Congress is huffing and puffing! They are even going to pass a token bill to prevent such illicit executive actions in the future – like this is anything new and like Obama will CARE that the rule of law stands in between amnesty – complete with work permits and access to Social Security and Medicare – and his next batch of five million "DREAMers".
"Congress must respond to the president's unlawful action by funding the government but not funding illegal amnesty," our border security hawk Sen. Jeff Sessions said in a public statement. "This is a perfectly sound and routine application of Congressional authority. In fact, the nonpartisan Congressional Research Service reports that last year's omnibus spending bill included 16 such funding restrictions on fee-based programs."
That's right – Congress implemented 16 such funding restrictions just LAST YEAR!
So BLAST Boehner and ALL of Congress and DEMAND to KNOW – why not NOW?

Breitbart News was provided a copy of the otherwise private report by Border Hawk Sen. Jeff Sessions (R-AL), which reads in part: "In light of Congress's constitutional power over the purse, the Supreme Court has recognized that 'Congress may always circumscribe agency discretion to allocate resources by putting restrictions in the operative statutes. Where Congress has done so, 'an agency is not free simply to disregard statutory responsibilities.' Therefore, if a statute were enacted which prohibited appropriated funds from being used for some specified purposes, then the relevant funds would be unavailable to be obligated or expended for those purposes."

To make his case, Erickson points to a statement released by the House Appropriations Committee FALSELY claiming Obama's Executive Order Amnesty (which in fact is almost certainly being perpetrated by "directives" and "actions" and not an attributable Executive Order) cannot be defunded:

The primary agency for implementing the President's new immigration executive order is the U.S. Citizenship and Immigration Services (USCIS). This agency is entirely self-funded through the fees it collects on various immigration applications. Congress does not appropriate funds for any of its operations, including the issuance of immigration status or work permits, with the exception of the "E-Verify" program. Therefore, the Appropriations process cannot be used to "de-fund" the agency. The agency has the ability to continue to collect and use fees to continue current operations, and to expand operations as under a new Executive Order, without needing legislative approval by the Appropriations Committee or the Congress, even under a continuing resolution or a government shutdown. |

They're correct that USCIS spending is funded primarily by fees collected by the agency, and that the spending is mandatory, rather than discretionary… The only thing that differentiates mandatory and discretionary spending is how often each must be re-authorized. Every single dollar spent by the federal government must be first appropriated by Congress. Just because some spending is not subject to annual appropriation doesn't mean it's not subject to appropriation at all. Congress can't block Obama's executive order by shutting down the government, but it most certainly can defund it by law. Congress adds riders and prohibitions to appropriations bills all the time. Why? Because it can. That's kind of the whole purpose of Article 1, Section 9 of the U.S. Constitution: No money shall be drawn from the treasury, but in consequence of appropriations made by law[.] And from that power of the purse come the most powerful words in federal law: "Notwithstanding any other provision of law, no funds shall be appropriated or otherwise made available for ______." |
THIS "DEFUNDING" THEN REMAINS IN EFFECT UNTIL REPEALED OR SUPERSEDED BY A FUTURE LAW!
Simply put, Obama's Executive Amnesty – or anything else – can be DEFUNDED AT ANY TIME and all the Congress has to do is add this language to ANY BILL, ANY TIME.

Kessler writes: The president has certainly been consistent on this issue—until he saw that the path through Congress was blocked. It's clear from the interviews that the president was not being asked about executive orders that would have provided comprehensive immigration reform, but about specific actions that ended deportations of a subset of illegal immigrants—precisely the type of action he will shortly unveil.
Previously he said that was not possible, using evocative language that he is not a "king" or "the emperor." Apparently he's changed his mind. The president earns an upside-down Pinocchio for his flip-flop.
Yet, the GOP still hasn't committed to defund Emperor Obama's unconstitutional deferred action carte blanche – as the readily could do in a stopgap spending bill (continuing resolution) as a rider…

"McConnell strikes a conciliatory tone, saying he hopes to work with President Obama and Senate Democrats. He said there would be no shutdowns on his watch, despite the fact that he plans to use funding bills to force changes in Obama's policies…"
"Finally, he named his new top priority: keeping the Senate in 2016 (though winning the White House is also 'not unimportant')."
There is no doubt about it – the priority for the establishment pols of BOTH parties in Washington is to get a lame-duck spending bill for FY 2015 PASSED through the Harry Reid Senate that FUNDS Obama's AMNESTY and "SOLVES" the GOP's problem of voters like us expecting them to keep their word and FIGHT for the rule of law…
Senators Cruz and Sessions have been explicit that this fight must be waged by Congress. Says Sessions:
"Here's how we can stop him: President Obama's executive amnesty will not be easy to execute. U.S. Citizenship and Immigration Services will have to be ordered to redirect funds and personnel away from its statutorily mandated enforcement duties and towards processing applications, amnesty benefits, and employment authorizations for illegal immigrants and illegal overstays. It is a massive and expensive operation. It cannot be implemented if Congress simply includes routine language on any government funding bill prohibiting the expenditure of funds for this unlawful purpose."
Senator Sessions has challenged both chambers…
"We cannot surrender Congress' most powerful Constitutional tool before a single newly elected Republican is sworn-in. Acting in this manner would betray the very voters who gave us this majority before we're even in possession of it."

The Hill and The Weekly Standard have recent reports confirming that both parties began formal meetings last week to negotiate a long-term omnibus spending bill. Despite all their empty promises to do "everything" they can to stop Obama's amnesty, IN FACT Republican House leadership is COLLUDING with Democrats to pass a spending bill through the 2015 fiscal year during the lame duck session and FUND Executive Amnesty. Now that Obama has acted, we need YOUR help calling Boehner and McConnell to account!
If passed under the Harry Reid Senate, cynical establishment Republicans believe they can once again "fool the voters" and get the cheap labor they seek while avoiding the demographic fight dread, and claim that this happened on the Democrats' watch with the GOP not to blame for AMNESTY FOR MILLIONS OF ILLEGAL ALIENS.
The federal government is currently funded through a continuing resolution that runs out at midnight on December 11. Rep. Matt Salmon of Arizona has proposed that Congress pass a short term spending bill that would fund the government only until early next year. Then if Obama indeed enacts his Executive Amnesty, the expiring continuing resolution allows Republicans an opportunity in the New Year to block funding for the president's action after both houses of Congress are under GOP control.

The UNCONSTITUTIONAL ten-point decree includes amnesty for up to 4.5 million illegal alien ADULTS with anchor babies (their children born here in America) as well as expanding Obama's DACA program allowing "child arrivals" to stay with no fear of deportation.
Already critics are pointing to one avenue of Executive Amnesty in the works that allows illegal aliens to join the military's delayed entry program – PLUS ALLOWS THEIR ILLEGAL IMMIGRANT FAMILY MEMBERS TO OBTAIN U.S. CITIZENSHIP – but too many "in" the program are bailing before boot camp, after their other paperwork has been processed.
Obama's Executive Amnesty plans further include a 50-percent fee discount to the first 10,000 naturalization applicants and MORE VISAS – as in HALF A MILLION MORE – for technology jobs.
Oh and non-detailed border security provisions – WHATEVER THAT MEANS.
